General Terms and Conditions - Trainings


1. Delivery conditions and payment terms

1.1. Delivery Conditions

Prevom does not guarantee passing the exam. Passing is dependent on the answers provided by the person taking the exam. The client must submit the names (first and last name) of these individuals at least 5 days in advance.

1.2. Invoicing

The full amount must be paid no later than 5 days before the start of the training. If our invoice remains unpaid, Prevom reserves the right to refuse the participant entry to the training and/or the exam.

Unless we have expressly accepted different terms in writing, all services/invoices provided by us are delivered under the following terms:

1. Complaints regarding the delivery of services or concerning invoices must be sent to us by registered mail within 8 days after the actual delivery of the relevant service or invoice.

2. Invoices from Prevom BV are payable within 30 days after the invoice date via transfer to the account number specified on the invoice issued by Prevom.

3. In the event of non-payment of the invoiced amounts on the due date, a flat fee of 10% on the unpaid amounts is automatically due by law, without the need for a prior formal notice, with a minimum of 60 EUR excluding VAT, in addition to all interest (10% per year) and any costs, collection costs, or legal costs. If regular reminders go unanswered, communication will take place via registered (or equivalent) letters. The latter will be charged at a rate of 30 euros per letter.

4. Disputes that cannot be resolved through mutual agreement will only be submitted to the courts of the district of Antwerp, Mechelen division.

1.3. Deferred payment

If the customer fails to make a payment or a partial payment, Prevom has the right to suspend the work until the owed amount is received by Prevom. Prevom is not responsible for any delays caused by this.

1.4. Accountability

The maximum total accountability of Prevom arising from or related in any way to this agreement, whether based on contract, warranty, indemnity, tort, strict liability, or other aspects, shall in no event exceed the net amount of the current quote. The customer hereby releases Prevom from any liability that exceeds this amount, and no additional or higher compensation may be claimed from Prevom.

All damage claims must be submitted to Prevom by registered mail within 8 days of determination. In the absence of this, the delivered materials and services are considered accepted.

The amount of the damage may in no case be deducted from the invoice that the customer owes to Prevom, unless there is an express agreement to this effect from Prevom.

Prevom shall in no event be held accountable for indirect or consequential damages, such as loss of performance, loss of revenue, loss of contracts, loss of clientele, loss of opportunities, production losses, loss of profits, costs due to delays, reputational damage, loss of a chance, etc. suffered by the customer.

This exclusion or limitation is also stipulated for the benefit of the employees and appointees of Prevom and for the benefit of those who have been engaged by it for the execution of the assignment.

1.5. Confidentiality

The parties commit to complete confidentiality of all information they acquire about or regarding the other party in the formation and execution of this agreement, unless they are required to use it for the performance of their assignment.

1.6. Applicable law, competent court

This contract is governed by Belgian law. The United Nations Convention on Contracts for the International Sale of Goods (CISG) and private international law, along with any references, are excluded.

The only competent court is Antwerp, Mechelen division, Belgium.

2. Cancellation Policy

If the customer does not show up (no-show) or cancels, the registration fee or invoice amount remains fully owed. The same applies when the customer requests to reschedule the appointment date within a period of two weeks prior to the scheduled appointment.

The customer has the right to reschedule the training once free of charge, provided that this request is submitted at least two weeks before the scheduled date.

If you do not participate in the exam or training, you will also not be able to obtain a certificate/attestation.

To obtain a certificate/attestation, you must successfully pass the exam or inter-nal test.

We make every effort to ensure that no examination or training session is ever cancelled by Prevom. However, if cancellation becomes necessary due to excep-tional reasons or extreme circumstances, you will be notified by phone or email.

In the event of a cancellation by Prevom, the registration fee will be fully refund-ed, without any additional compensation beyond the initial amount paid at the time of booking.

If, on the day of training, it is determined that the practice cannot be conducted safely, we reserve the right to discontinue the training without refunding the amount due.

3. Validity of the proposal

This offer is valid for 4 weeks.

If market conditions do not require adjustments, this proposal will remain valid beyond this period.

Any reservations to the general terms and conditions or in an omission, which deviate from this proposal, shall only apply if expressly confirmed in writing by Prevom. This also applies to any amendments made to this proposal.
